GENERAL TERMS OF TRAVEL PARTICIPATION IN ORGANIZED JOURNEY (July 1, 19)

 

Based on Presidential Decree 7/2018, pursuant to Directive EE 2015/2302

Please read carefully the following General Terms of Participation, which are an integral part of the organized travel contract, as well as information and any other recommendations given to you before you sign up for any of our organized trips. Participation in any organized trip of our travel agency, presupposes the careful study of the program of the specific trip and means the unconditional acceptance by the traveler / excursionist of the General Terms of Participation, according to the P.D. 7/2018. Therefore, you enjoy all the rights provided in the EU for these packages. The General Terms and Conditions of General Participation include general information, as well as the rights and obligations of the two Contracting Parties to the organized trip, and specific information (destinations, prices, days and hours of departure and return, means of transport, accommodation, visits, etc.). , which relate to each organized trip separately, you must consult the current program and the relevant price list. The travel plans are valid for the period indicated in the relevant forms or on the IOLETravel site (www.ioletravel.com.gr) (where any changes, corrections and information about the trips are mentioned, which bind all travelers) and in indivisible in combination with the current price list.

 

  1. CORRECTOR – TOURIST OFFICE

Georgoudi  Street 45-Loutron, number MH.TE 0933E60000071500, with contact phone number 2394020531, email info@ioletravel.gr  From now on it will be called “Tourist Office”, it is a member of the Association of Tourist and Travel Agencies in Greece (Member number of HATTA 2111) of the Association of Tourist Offices of Macedonia-Thrace and is a travel organizer, either alone or in joint cooperation with other tourist offices as intermediaries between other travel agencies as well as means of transport, with the ultimate goal of selling these organized trips to the traveler / excursionist.

  1. GENERALLY

The information, data and recommendations contained in the General Terms of Participation have been verified by our office, for their validity and accuracy, are general in nature and are valid as they are, unless otherwise specified or specified in the travel plan. The programs, including the current price list, are valid for the period indicated in them. Travel program information and details may change due to emergency changes. In this case, you will be notified immediately in the most appropriate way and therefore we must have all your contact information, for the declaration of which you are solely responsible. Any of your special wishes, needs or requirements regarding your trip should be explicitly included in the contract, as long as they have been agreed and are feasible.

 

  1. REGISTRATIONS – PARTICIPATION IN ORGANIZED JOURNEYS

Registrations are made by visiting our offices or the offices of our partners, by mail (postal or electronic), fax, telephone and through our website on the internet, provided (in order to commit positions on this trip): 1st of the payment of the advance payment or the full amount, in cash, by credit / debit or prepaid card or by transfer to the tourist office, within 48 hours, and 2nd of the unconditional acceptance and compliance with these General Terms. For the valid registration, the specific trip must be indicated on the receipt of payment of the advance payment, with the dates of departure and return and any other discreet information. The right to participate in the trip is guaranteed by the payment of the total value and the relevant charges 10 full days before departure, unless otherwise specified in the relevant Convention. Any non-payment of the total value of the trip in the allotted time, entitles our travel agency to cancel the reservation and, possibly, to cancel cancellation fees, in accordance with the cancellation terms provided herein. The contractor, who represents his family or team, has the obligation to inform all his fellow travelers about the details and terms of the trip. Participants through a third party have the same obligations as the representative who registered them on the trip, and the travel agency provides them with any relevant information whenever requested.

The tourist services that will be provided to you, as well as the relevant costs, are detailed in the Organized Travel Agreement that you will have to sign. In case your physical presence is not possible (reservation by phone, mail, etc.) you will receive the Contract via e-mail (in this case you have the right to withdraw from the contract within 14 days from the date it was sent to you to your email, taking into account the relevant cancellation fees referred to in Article 11 thereafter).On organized air travel, your escort will be at the arrival airport and services will begin and end with arrival and departure from / to the airport of destination of the trip respectively. The travel agency reserves the right to replace the leader / companion during the trip. In some cases the escort is done with local representatives. Our travel agency is not responsible for the days and hours of operation of the markets, museums and archeological sites.

  1. TRAVEL PRICES – REPAIRS ETC.

The value-price of the trips is mentioned in our current price list. Travel prices are calculated on the day the price list is issued, based on the cost of services of each trip, the cost of fuel or other energy sources, the current fares / fees, any kind of taxes or fees, the exchange rate of foreign currencies in relation to the € (Euro), as well as any other cost factor (eg minimum number of participants etc.). Our travel agency, after exhausting all possibilities of forecasting, reserves the right to adjust prices when the above cost factors change. In particular, the price of the trip can be changed up to 20 days before the start of travel services. The specific price increase will be communicated to the traveler calculated in detail in a clear, understandable and distinct way. In the event of a significant price increase (ie more than 8% of the value of the trip) for the above reasons, the traveler may terminate the contract without paying a complaint fee and be refunded the exact amount paid. If the traveler terminates the organized travel contract for the above reason, then the traveler may receive another package of equivalent or superior quality. It is the duty of the traveler to notify our tourist office in writing of any decision within a reasonable period of time, which in no case may exceed 3 days from the moment the price increase is notified. In case the traveler does not respond in writing within the above deadline, the tourist office is obliged to cancel his participation and return all the money he has paid without any other obligation, taking into account the relevant cancellation fees referred to in Article 11. subsequently. Also, our travel agency has the right, for a certain period of time or for a limited number of places, to pre-sell seats at more favorable prices, with special terms of cancellation fees. Children’s charges vary from free accommodation, without food, to hotels and ships, to a small discount (for ages 2-12, usually only when two adults pay in the same room / cabin). Usually the prices do not include accommodation taxes and municipal taxes. In Greece, the accommodation tax per room / suite and per night is: Hotel 3 *: € 1.50, 4 *: € 3.00, 5 *: € 4.00 and based on the relevant law is paid by the customer directly at each hotel.

 

  1. OBLIGATIONS – RESPONSIBILITIES OF TOURIST OFFICE

Our travel agency has the obligation to coordinate and execute in the best possible way the trips it has for travelers. However, having exhausted any possibility of provision and care, it is not responsible for incorrect actions and omissions of third parties and their associates, as well as for emergencies such as cancellations, delays or changes in routes of various means of transport (aircraft, ships, buses, buses). .) or in case of exclusion (“embargo”) of areas due to terrorist acts, strikes and other causes of force majeure. The travel agency cannot anticipate or control any delays on chartered flights or charter flights or ships for technical or meteorological or other reasons (and therefore travelers should not plan significant personal activities or combine other transfers. , days of departures / arrivals).It is emphasized that the travel agency is not able to anticipate or control circumstances that are foreign to its sphere of influence and may lead to the cancellation of the trip or to damages due to non-performance or faulty performance of the agreed travel services. Typical examples of such cases are: strikes, accidents, diseases, epidemics, organic disturbances due to local conditions, altitude, climate, due to meals not included in the itinerary or due to insufficient hygiene conditions due to external factors, external factors, injuries or injuries. terrorist acts, airstrikes, earthquakes, weather conditions, fires, epidemics, toxic infections and any other state of emergency or force majeure. In the above cases, our travel agency bears no responsibility for repairing any damage caused by them, but will make every effort to support and care for travelers in any way, without substantiating any responsibility or obligation to cover them. relevant emergency expenses, which should be covered, as in the case of force majeure, by the travelers themselves.

Reasonable complaints during the trip must be reported immediately and on the spot to the escort (or, in the absence of that, to our office), and to the service provider in writing. If the problem has not been resolved on the spot, upon your return from the trip, you must submit in writing to our office any relevant complaint within 7 working days, along with any documents or other evidence available to you. his justification. After 7 days, our travel agency has no obligation to respond to any request. If there is damage due to non-performance or poor performance of the organized trip, the compensation to the customer is limited to what is specified in the international conventions that bind the country and govern those benefits. In particular: Compensation based on non-performance or faulty performance of organized travel benefits is limited to twice the value of the individual price of the trip.

To be able to make an organized trip, the minimum number of 20 (twenty) participants required (not including children under 12) is required. For long-distance travel, the minimum number of participants is limited to 15 (fifteen) people or the number specified in the itinerary. If this number is not met, our office reserves the right to cancel this trip, and must notify customers who have declared their participation and return the money they have paid, without any other obligation.

The travel agency only offers the benefits mentioned in the descriptions of organized travel programs. Any optional benefits are available at an additional cost, if possible. Our travel agency bears absolutely no responsibility for the optional benefits, which are mainly provided by local agencies.

After the completion of your trip, our travel agency will issue the tax documents provided by law, which will be received by our offices during the working days and hours of the financial services (from Monday to Friday 10: 00-17: 00 ).

  1. OBLIGATIONS – RESPONSIBILITIES OF TRAVELERS

Because other people usually take part in the organized trip, it is necessary to have the appropriate social behavior and the absolute compliance of the travelers with the itinerary and the instructions of the escorts or guides and their timely arrival at the gathering places for the various benefits of the program (flights). , transportation, guided tours, excursions, meals, etc.). If the delay or inconsistency of the traveler results in the loss of flight, excursion, travel or any other service offered, the traveler should reconnect with the team at his own risk and expense, without the right to a refund for lost or lost service. and for the whole trip, if he fails to reconnect. The travel agency will make every effort to assist him, without having or assuming any obligation or responsibility.

You must be at the airports and ports at least two (2) hours before your departure. If there is no attendant on the trip, you must confirm on the spot your next flights with the airline and make sure at what time and from which airport and station (terminal) your flight departs.

In the event that a traveler interrupts his journey by his own decision and leaves the group, he is not entitled to any further service or compensation and the responsibility and costs of any movement outside the group are borne solely by him. In the same way, our office bears no responsibility for the services of the organized trip which were not provided to the traveler by his own negligence or responsibility, due to his illness or sudden accident. In case the customer is prevented from participating in the organized trip in which he has reserved, he can assign (by notifying our office in writing) his reservation to another person, who meets the conditions for participation in this trip, no later than 7 days. before the start of travel services, while for maritime transport the corresponding deadline is 10 working days before departure. The replacement (contractor) and the original participant (assignor) are jointly and severally liable to our travel agency, to pay to him any remaining balance of the amount, as well as the possible additional costs of this assignment. It is clarified that any change should be exactly within the same framework and will be acceptable as long as all service providers on the organized trip (commercial companies, hotels, etc.) accept the changes. Travelers are responsible for the actions of the children they accompany and must monitor them continuously throughout the journey for their safety and behavior.

Especially in the case of airlines, it should be noted that it is not allowed to change the personal data of the passenger, but only the cancellation of the existing reservation and the reservation of a new position, if this is possible at the appropriate cost. Our travel agency does not bear any responsibility in case this is not possible, and the consequent mandatory cancellation of the reservation will be made in accordance with the provisions of this or the service providers of cancellation terms. In the case of air tickets that have been issued on return or multiple routes, it is not always possible to use individual tickets for the ticket. The user should contact the travel agency directly to be informed of the policy pursued by each airline.

  1. HOTELS /BOATS AND OTHER THROUGH TRANSPORTATION

All information regarding the categorization or classification of hotels and accommodation mentioned in the programs of our organized or sold trips is in accordance with the applicable legislation of each State for the tourist classification of hotels and accommodation, which may differ. from country to country. The rooms of most hotels accommodate two beds or a semi-double. The triple rooms are, in fact, double with extra bed. They are usually not very comfortable and the extra bed can be smaller than normal or sofa or folding. Rooms are usually delivered by the hotel between 14: 00΄-16: 00΄ and are available to tenants until 10.00΄-12.00΄ on the day of departure (depending on the policy of each Hotel). If you wish to enter the room earlier or leave later, you will have to pay the relevant charge (if there is a corresponding availability). If, due to unforeseen difficulties, the tour operator is forced to change a hotel with another of the same or higher category, the travel agency is not obliged to pay any other compensation to the travelers.

In case of delayed arrival at the hotel, after the day or time of the planned arrival of the traveler, and if he has not informed the hotel in time, he has the right to cancel the reservation and make the room available for the entire period of the reservation, if asked.

In case of excessive bookings, our travel agency will try to replace the room with another hotel room of the same category or if this is not possible with a lower class hotel room and will return to the customer the difference without our travel agency bringing any further responsibility or liability. On bus trips on trips to Greece the seats are given in order of registration and do not change during the trip, while on trips abroad they change daily. Smoking on the bus is prohibited. The duration of an all-day visit / excursion does not exceed nine (9) hours in total, always calculated from departure to return to the hotel. The duration of a half-day visit / excursion will not exceed four (4) hours, always calculated from departure to return to the hotel.Airlines, for their own reasons, sometimes charter flights for another airline. This case is not a reason for the customer to cancel the trip or claim any compensation.We recommend that you do not leave exposed and constantly monitor all your personal items (eg mobile phones, etc.) in any place (hotel, ship, plane, bus, etc.). In hotels in particular, it is an international practice not to take responsibility for money or valuables left in the room. For such cases there are often small safes.

 

  1. ADMINISTRATION, INCOME THEORIES & HEALTHY DIFFERENCES

The passport must be valid for as long as the scheduled return date is set by the destination countries. Schengen countries also accept the new type, with Latin characters, police IDs.Our travel agency provides all the necessary information regarding travel and other documents required for Greek citizens, for any trip and destination and their issuance and / or visa, but (even if it provides some assistance in the relevant process) It is not responsible for any non-issuance or non-issuance of these by the competent authorities to which the traveler should go, nor is it responsible if the validity of the visa is less than the duration of the trip (ie the dates do not coincide. disasters) or if the couple of travelers have different nationalities together, outside Schengen. In particular, nationals of other countries who hold foreign passports must inform the tourist office and contact the consular authorities of their country, as well as the countries they will visit, in order to check whether they need an entry visa or any other documents. for the countries they will cross or travel to, as well as for their return to Greece or the country where they started. Any failure to secure the timely issuance or visa of your travel documents does not justify the cancellation of your participation in the trip without charge of cancellation fees. Each traveler is responsible for the validity and validity, security and safekeeping of his travel documents required for his journey. The traveler is responsible for the storage of tickets and in general all travel documents throughout the trip.The parent who accompanies a minor child alone must bring with him a validated English language authorization from the other parent who is not traveling. A similar procedure is followed in a case where the minor is not accompanied by any parent / guardian, in which case a validated authorization is required from both parents. In any case, our office does not bear any responsibility if the local authorities do not accept their entry into their country or the airline does not allow them to enter the flight.

The traveler is obliged to comply with the national provisions and regulations as well as the instructions of the national authorities. Our travel agency does not bear any responsibility in case the traveler faces criminal prosecution, is summoned to appear before a court, is arrested by the local authorities, etc.

Our travel agency provides all the information you need about vaccinations or other medical precautions for tropical or other outbreaks. Due to the confidentiality of medical personal data – sensitive personal data – only the traveler himself is responsible for addressing the relevant health authorities. The traveler is obliged to be informed in time by the local health offices about the health regulations of each country, as well as about the vaccines or medicines that may need to be procured. Customers who have health problems should get their doctor’s consent to travel, providing a medical certificate or a responsible statement that they can travel safely. Our office bears absolutely no responsibility for illness, injury, loss of life, accident or other emergency during the trip. In the event of a similar incident, the travel agency will try to assist the victim as much as possible, but is not obliged to cover any relevant exit and change the itinerary, which will continue smoothly.

 

  1. INSURANCE

Our travel agency has concluded for each trip organized by an insurance contract of Civil Professional Responsibility with an Insurance Company. The number of the insurance policy and the details of the insurance company are indicated in the contract of organized travel. The insurance policy deals, among other things, with the case of insolvency of the organizer, covering all travelers regardless of their place of residence, place of departure or the place of sale of the travel service.A travel insurance policy that covers travel accident insurance, medical / hospital travel expenses, luggage loss and delay, travel expenses, and the repatriation of travelers resulting in injury or illness, and other benefits exceeds the 75th year of age. In contrast, for people over 75 there is a specific travel insurance coverage, which is limited to cases: Repatriation expenses only from accident or death, loss of luggage, personal travel liability of the traveler, expenses of A ‘necessity due to delay in arrival of luggage over 4 hours , travel or cancellation costs if during the trip there is a serious health problem in members of his family in Greece, return of advance (cancellation expenses) in case of inability to participate in the trip or due to death or serious incident in a second degree kinship. Also, to address a case of illness during a trip within the European Union, we recommend that travelers contact their insurance company for the issuance of the “European Disease Insurance Card”, which is, however, optional. The travel agency therefore unreservedly recommends to travelers an optional insurance with the coverages and amounts they wish, for life insurance, accidents, luggage, etc., as international conventions limit the responsibilities of carriers, which they can also purchase from offices. us at a cost specifically designed for them.

  1. LUGGAGE

The luggage is transported with the responsibility and care of their owners, regardless of the presence or absence of representatives of our tourist office. In the event of damage or loss, the relevant international treaties apply to all means of transport and to hotels, and liability in this case is limited to those provided for in these terms. Our travel agency is not responsible for the contents of the luggage.

On air travel, only 1 piece of luggage per passenger is allowed, usually weighing a maximum of 20 kg. In case of additional costs, due to the heavier weight of luggage than allowed, these are borne exclusively by the traveler and are paid on the spot at the airport. It is also noted that the airlines allow only one small hand luggage (approximately 50x40x25) in the passenger cabin. The traveler is obliged to comply with the guidelines, regulations and general policy of the airline in the matter of excess baggage for which the airline is solely responsible and therefore our travel agency bears absolutely no responsibility for it. . In case of damage or loss, the IATA Regulation applies.

  1. CANCELLATIONS

Cancellation of participation by the traveler is made only in writing to our office and, regardless of the date of reservation (and if it is not possible to assign his reservation to another person with the conditions mentioned in Article 6 of the General Terms of Participation), are subject to the following cancellation fees per person, depending on the time at which the cancellation is made, and are independent of whether the respective amounts have already been paid by the travelers or not:

For trips to Greece and abroad (and as long as there is no different cancellation policy from the carrier or the hotel), except for “long” trips and trips to the Russian Federation:

Up to 45 days before departure: 50 € for trips to Greece and 150 € for trips abroad, per person, for administrative expenses.

From 44 to 30 days before departure:

From 29 to 14 days before departure:

From 13 days before departure to departure (non show – non-appearance): 100% of the total value of the trip.

For cruises, different cancellation terms apply according to the terms of the contracts of each company that apply to each excursion – cruise.

For individual / individual trips, different cancellation terms apply according to the terms of each airline fare as well as the cancellation policy of each hotel.

In cases of non-refundable fares (inside or outside Greece), cancellations even reach 100%, as determined by the airline or shipping company and refer to the program of the trip or the offer.

For the so-called “long-distance” trips of the relevant programs of our Office as well as for trips to the Russian Federation, the cancellation fees are as follows:

Up to 2 months before departure, the total deposit (40% of the total value of the trip) for management costs.

Up to 30 days before departure, 50% of the total value of the trip.

30 days before departure until departure (non show) 100% of the total value of the trip.

The above applies even in cases where the customer does not participate in all the events of the program and / or uses his own means of transport (and if there is no different cancellation policy from the carrier or the hotel).

For departures during celebrations, sporting or artistic exhibitions, cruises or trips by specially chartered flights or ships, the above-mentioned cancellation periods may be higher and booking rates higher, as explicitly stated in the program.

Charges are made regardless of the time of registration or whether the corresponding amounts have already been paid by the travelers or not. In the event that one of the two persons who have chosen to reside or resides in a double room cancels his participation, he will pay the corresponding cancellation fees. As long as the above cancellation fees are not equal to 100% of the total value of the trip, the person who will eventually travel will also pay the difference of his room, as he will be forced to stay in a single bed.

In case of cancellation of the trip by the Tourist Office and if the time of the reservation allows, the following deadlines for the Traveler are as follows:

20 days before the departure date, when the trip lasts more than 6 days,

7 days before the departure date, when the trip lasts between two and six days,

48 hours before the departure date, when the trip lasts less than two days.

  1. DIFFERENCE OF DIFFERENCES

We make sure that we comply with applicable law, both nationally and at European level, regarding the proper use of personal data. The travel agency and the traveler are committed to resolving in good faith any dispute that may arise during the execution of the contract of the organized trip.

In case of failure of the relevant efforts, the parties undertake to address the Committee for the Friendly Settlement of Disputes of the Association of Tourist and Travel Agencies in Greece or the Association of Tourist Offices of Macedonia-Thrace and request its mediation. If the amicable settlement of the dispute is not possible, the Courts of Thessaloniki are competent.
